Drunk driving is a serious crime in California. Under the California Vehicle Code, a person is considered to be driving while under the influence of alcohol if his or her blood alcohol concentration (BAC) exceeds a .08 level. The BAC may be measured at the scene with a breathalyzer, or taken from a blood sample later in a laboratory.
Driving with a BAC of .01 or .02 is an infraction, punishable by a fine of $100 for the first offense, $200 for the second offense, and $300 for any offense thereafter. For BACs of .05 and higher, drivers face misdemeanor charges. A first offense is punishable by six months in county jail, a fine of $200 to $1,000, or both. A second offense is punishable by a jail term of at least 48 hours, a fine of $350 to $1,000, or both. A third or subsequent offense is a misdemeanor punishable by imprisonment in county jail for up to one year, a fine of $390 to $1,000, or both.

Drivers in California also face penalties for refusing to take a breathalyzer or blood test. The penalties are the same as those for driving with a BAC of .08 or higher.
